Self-Defence and the law
Section on the Law by Barrister David Winfield LLM LLB (hons)
Introduction
It is the task of the Government, the Judiciary, Crown prosecution Service and Police, to apply the rule of law in order to keep the Queens Peace so that we, the public can go about our daily business in peace.
The law makers take a pragmatic and practical approach to the application of the law. They realise that it is an advantage to allow a degree of latitude to members of the public who by their actions contribute to the preservation of the Queens peace. In particular in relation to:
• Self defence;
• Defence of another
• Prevention of crime
• Lawful arrest and the apprehension of offenders.
The law on the other hand discourages vigilantism and the use of Violence generally. It does this by ensuring that all those acting in self defence do so reasonably and in good faith to defend themselves, their family, their property or in the prevention of crime or the apprehension of offenders. In so doing members of the public are not to be prosecuted for such action unjustly.
